This Domain Name Transfer Agreement ("Agreement") governs the transfer of domain name registrations to or from AviumsHost. By initiating a domain transfer through our services, you agree to be bound by the terms of this Agreement, along with our Terms of Service, Domain Name Registration Agreement, and any applicable ICANN or registry policies.

1. Overview and Scope

This Agreement applies to all inbound domain transfers (moving your domain to AviumsHost from another registrar) and outbound transfers (moving your domain from AviumsHost to another registrar). By submitting a transfer request, you acknowledge that:

  • • You have read and understood this Agreement and all incorporated policies
  • • You authorize AviumsHost to act on your behalf in facilitating the transfer with the relevant registries and registrars
  • • The transfer is subject to the rules and policies of ICANN, the relevant TLD registry, and the involved registrars
  • • We may update this Agreement to comply with changes in ICANN policies, registry requirements, or applicable laws

2. Transfer Eligibility and Requirements

2.1 Eligibility Criteria

For a domain name to be eligible for transfer to AviumsHost, it must meet the following requirements:

  • • The domain must be at least 60 days old from its initial registration date (ICANN requirement for most gTLDs)
  • • The domain must not have been transferred to another registrar within the last 60 days
  • • The domain must be unlocked at the current registrar
  • • A valid authorisation code (EPP/Auth code) must be obtained from the current registrar
  • • The administrative contact email address on file with the current registrar must be accessible to approve the transfer
  • • The domain must not be in a locked, hold, or disputed status
  • • The domain must not be expired or within the redemption grace period

Some TLDs (particularly country-code TLDs like .uk, .eu, .cn) may have additional or different transfer requirements. It is your responsibility to verify these requirements before initiating a transfer.

2.2 Your Representations

By submitting a transfer request, you represent and warrant that:

  • • You are the legal registrant of the domain name or have authorisation to act on behalf of the registrant
  • • All information provided in the transfer request is accurate and complete
  • • The domain name is not subject to any dispute, UDRP proceeding, or legal action that would prevent transfer
  • • You have not provided false or misleading information to obtain the transfer

3. Transfer Process

3.1 Initiating a Transfer

To initiate a transfer to AviumsHost, you must:

  • • Submit a transfer request through our website, providing the domain name(s) to be transferred
  • • Pay any applicable transfer fees (some TLDs may include a one-year renewal upon successful transfer)
  • • Provide the correct authorisation code (EPP code) for each domain
  • • Ensure the domain is unlocked at your current registrar

3.2 Transfer Approval

Once initiated, the transfer proceeds as follows:

  • • An approval email is sent to the administrative contact listed in the current registrar's WHOIS
  • • You must respond to this email or click the approval link within the specified timeframe (typically 5-7 days)
  • • The current registrar may also send a transfer confirmation request
  • • If approved, the registry processes the transfer, which may take up to 5-7 days depending on the TLD

For some TLDs, the transfer may be processed automatically without explicit email approval if the domain is unlocked and the authorisation code is correct.

3.3 Transfer Completion

Upon successful transfer:

  • • AviumsHost's affiliated registrar becomes the new registrar of record
  • • The domain's expiration date is typically extended by one year (where applicable and subject to registry rules)
  • • You will receive confirmation of the completed transfer
  • • The domain will appear in your AviumsHost account for management

4. Failed, Rejected, or Cancelled Transfers

4.1 Reasons for Transfer Failure

Domain transfers may fail or be rejected for various reasons, including but not limited to:

  • • Incorrect or invalid authorisation code (EPP code)
  • • Domain locked at the current registrar
  • • Transfer request rejected by the administrative contact (or failure to approve within timeframe)
  • • Domain less than 60 days old since initial registration or last transfer
  • • Domain expired or in redemption grace period
  • • WHOIS information mismatch or inaccurate contact details
  • • Domain subject to dispute, litigation, or UDRP proceeding
  • • Registry-specific restrictions or requirements not met
  • • Transfer request older than 30 days without completion

4.2 Consequences of Failed Transfers

If a transfer fails or is rejected:

  • • The domain remains registered with the original registrar
  • • Any transfer fees paid may be refunded at our discretion, depending on the reason for failure
  • • You may re-attempt the transfer after resolving the issues that caused the failure
  • • We are not liable for any losses resulting from failed transfers

5. Recently Renewed Domains and Lost Years

You acknowledge and understand that special considerations apply to domains renewed shortly before or after expiration:

  • • If a domain was renewed during the 45-day grace period following expiration, and less than 45 days have passed since expiration, the renewal year may be lost upon transfer
  • • In such cases, the domain's expiration date may not be extended by a full year, and you may effectively forfeit the renewal fee paid to your previous registrar
  • • AviumsHost is not responsible for any lost renewal years and will not provide refunds or credits for such losses
  • • You should contact your previous registrar regarding any refund or credit for the lost renewal period
  • • We do not intervene in disputes between you and your previous registrar over lost renewal years

6. Fees and Payments

6.1 Transfer Fees

Transfer fees, if applicable, are displayed during the checkout process. These fees are generally non-refundable once the transfer process has been initiated, except as provided in our Refund Policy or in cases where the transfer fails due to an error on our part.

6.2 Year Extension

Most TLDs automatically extend the domain's registration by one year upon successful transfer. This extension is added to the existing expiration date. Some TLDs may not offer this extension, or may have different renewal terms. You acknowledge that:

  • • The year extension is subject to registry policies and may not apply to all TLDs
  • • In some cases, the extension may be less than a full year depending on the timing of the transfer
  • • Premium domains may have different renewal pricing than standard domains

7. Outbound Transfers (Transferring Away from AviumsHost)

7.1 Transferring to Another Registrar

If you wish to transfer a domain name registered through AviumsHost to another registrar, you must:

  • • Unlock the domain in your AviumsHost account
  • • Obtain the authorisation code (EPP code) from your account
  • • Ensure your WHOIS contact information is current, as transfer approval emails will be sent to the registrant or administrative contact
  • • Initiate the transfer with the gaining registrar
  • • Respond to any transfer confirmation emails sent by us or our affiliated registrar

7.2 Transfer Restrictions

Outbound transfers are subject to the following restrictions:

  • • Domains cannot be transferred within 60 days of initial registration or a previous transfer (ICANN requirement)
  • • Domains that are locked, on hold, or subject to dispute may not be transferred
  • • Domains with expired registration or within the redemption grace period are not eligible for transfer
  • • Some TLDs may have additional transfer restrictions or requirements

7.3 No Refunds

Fees paid for domain registrations or renewals are not refundable if you transfer the domain to another registrar before the end of the registration term.

8. Domain Locks and Registrar Locks

To prevent unauthorised transfers, domains are typically placed in a "locked" status by default. You must unlock the domain in your account before initiating an outbound transfer. After the transfer is complete (whether inbound or outbound), the domain may be locked by the gaining registrar for security purposes.

We may also lock domains in certain circumstances, including but not limited to:

  • • Upon request from law enforcement or pursuant to a court order
  • • During a UDRP or other dispute resolution proceeding
  • • If we suspect fraudulent activity or unauthorised access to your account
  • • To comply with ICANN or registry requirements

9. Dispute Resolution

You acknowledge that domain transfers may be subject to dispute resolution procedures, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP). In the event of a dispute:

  • • We may lock the domain or suspend a pending transfer until the dispute is resolved
  • • We may be required to comply with decisions issued under the UDRP or by a court of competent jurisdiction
  • • You agree to indemnify and hold us harmless against any claims arising from a disputed transfer

10. Limitation of Liability

To the maximum extent permitted by law, AviumsHost and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to domain name transfers, including but not limited to:

  • • Failure or delay in completing a transfer
  • • Loss of a domain name due to failed or rejected transfers
  • • Loss of registration years as described in Section 5
  • • Actions or omissions of the losing or gaining registrar, or the registry
  • • Unauthorised transfers resulting from compromised account credentials or failure to secure your account

Our total liability shall not exceed the amount you paid for the transfer service giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless AviumsHost, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • • Any transfer request submitted through your account
  • • Any violation of this Agreement or applicable policies
  • • Any dispute with a third party regarding a domain transfer
  • • Any misrepresentation or inaccurate information provided in connection with a transfer

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory dispute resolution policies (such as the UDRP) apply.
