This Domain Registrant Agreement ("Agreement") sets forth the terms and conditions between you ("Registrant") and AviumsHost regarding the registration, management, and use of domain names registered through our services. This Agreement is incorporated by reference into our Terms of Service and Domain Registration Agreement.

1. Registrant Obligations

1.1 Accurate Information

You must provide and maintain current, complete, and accurate information for your domain registration, including:

  • • Full legal name of the registrant (individual or entity)
  • • Current postal address
  • • Valid email address
  • • Working telephone number
  • • Administrative, technical, and billing contact details (if different from registrant)

Providing false, inaccurate, or outdated information, or failing to respond to inquiries about the accuracy of your information within 5 calendar days, constitutes a material breach of this Agreement and may result in suspension or cancellation of your domain.

1.2 Compliance with Policies

You agree to comply with all applicable:

  • • ICANN policies and requirements, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP)
  • • Registry policies for the specific TLD in which your domain is registered
  • • AviumsHost's Acceptable Use Policy and Terms of Service
  • • All applicable laws and regulations

1.3 Account Security

You are solely responsible for maintaining the security of your account and authentication information. Any modifications to your domain by anyone using your account credentials will be treated as authorised by you. We are not liable for any unauthorised access to your account.

2. Representations and Warranties

You represent and warrant that:

  • • You have the legal capacity and authority to enter into this Agreement
  • • All information provided is true, accurate, and complete
  • • The domain name registration does not infringe any third-party intellectual property rights
  • • You are not registering the domain for any unlawful purpose
  • • You meet any eligibility requirements for the specific TLD (residency, legal status, etc.)
  • • You will not use the domain in connection with illegal activities, malware, phishing, spam, or fraud

3. Rights of AviumsHost, Registry Operators, and Service Providers

We and our service providers reserve the right to deny, cancel, suspend, or transfer any domain registration, or place it on lock/hold status, in our sole discretion, under the following circumstances:

  • • To correct mistakes made by us, the registry, or any service provider
  • • For non-payment of fees
  • • Upon receipt of a court order, arbitration award, or UDRP/URS decision
  • • To comply with applicable laws, government requests, or ICANN mandates
  • • If we determine your registration or use violates this Agreement or our Acceptable Use Policy
  • • To protect the integrity and stability of the domain name system
  • • If you provide inaccurate or false WHOIS information
  • • During resolution of a dispute concerning the domain
  • • To avoid any liability, civil or criminal, on our part or our service providers

No refund will be provided for domains suspended or cancelled under this section.

4. WHOIS and Data Processing

You acknowledge and consent that:

  • • Your personal information will be collected, processed, and published in the public WHOIS directory as required by ICANN and registry policies
  • • Your information may be shared with the relevant registry operator, escrow providers, and other third parties as necessary for domain administration
  • • Your information may be transferred across international borders
  • • The registry operator and we may use your information in accordance with applicable privacy policies
  • • You are responsible for notifying any third parties whose information you provide about these uses

Where privacy/proxy services are available and purchased, your personal information may be shielded from public WHOIS, subject to the terms of that service.

5. Dispute Resolution

You agree to be bound by the applicable dispute resolution policies, including:

  • • ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP)
  • • Uniform Rapid Suspension System (URS)
  • • Any registry-specific dispute resolution policies
  • • Court proceedings in appropriate jurisdictions

In the event of a dispute, you agree to:

  • • Indemnify and hold us harmless from any claims arising from the dispute
  • • Not make changes to the domain without our approval during pending dispute proceedings
  • • Submit to the jurisdiction of the courts of your domicile, our location, or the registry operator's location, as applicable

6. Renewals and Expiry

You are responsible for timely renewal of your domain registrations. As a convenience, we may send renewal reminders, but failure to receive such reminders does not excuse your responsibility. After expiration:

  • • Domains may enter a grace period during which renewal is possible (often with additional fees)
  • • After the grace period, domains may enter a redemption period where restoration is possible but incurs significant fees
  • • If not renewed or restored, the domain will be deleted and become available for public registration
  • • Redemption and restoration fees vary by TLD and are non-refundable

After expiry and deletion, you have no further rights to the domain, and we or the registry may monetise or dispose of it as permitted by applicable policies.

7. Transfer of Registrant (Change of Ownership)

Changes of registrant (ownership transfers) are subject to the following:

  • • Both the current and new registrant (or their authorised agents) must confirm the change
  • • The domain may be locked for 60 days following a change of registrant (unless you opt out where permitted)
  • • We may act as your designated agent to approve registrant changes on your behalf
  • • We may deny a change of registrant if the domain is in dispute, expired, or if authorisation cannot be verified

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SERVICE PROVIDERS, REGISTRY OPERATORS, AND THEIR RESPECTIVE AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THIS AGREEMENT OR YOUR DOMAIN REGISTRATION, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE DOMAIN REGISTRATION DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless AviumsHost, its service providers, registry operators, and their respective affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • • Your domain registration or use
  • • Any breach of this Agreement
  • • Any infringement of third-party intellectual property or other rights
  • • Any dispute with a third party regarding your domain
  • • Any action we take as permitted by this Agreement

10. Modifications to This Agreement

We may revise this Agreement at any time to comply with changes in ICANN policies, registry requirements, or applicable laws. Revised terms will be effective immediately upon posting to our website. Your continued use of the domain after such revisions constitutes acceptance. If you do not agree to the revised terms, you may request cancellation of the domain (without refund) within 30 days of the revision.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory dispute resolution policies (such as the UDRP) apply.
