1.2 Intellectual Property Infringement

  • Copyright Infringement: Unauthorized distribution, sharing, or hosting of copyrighted material, including music, videos, software, images, e-books, or other protected works [citation:2][citation:9].
  • Trademark Infringement: Using others' trademarks, logos, or service marks without authorization in a way that may cause confusion or dilute their rights.

1.3 Adult and Obscene Content

  • Obscene Material: Content that is obscene, indecent, or offensive as determined in our reasonable discretion [citation:9].
  • Sexual Services: Promoting or facilitating prostitution, escorts, adult webcams, or other sexual services [citation:3].

1.4 Fraudulent and Deceptive Content

1.5 High-Risk Activities

  • Dangerous Activities: Websites or applications related to nuclear facilities, air traffic control, life support systems, medical devices, or other activities where failure could lead to death, personal injury, or environmental damage, unless explicitly approved in writing [citation:9].
  • Controlled Substances: Sale or distribution of prescription medications without a valid prescription, illegal drugs, or controlled substances [citation:3][citation:4].
  • Weapons and Explosives: Content related to illegal weapons, explosives, or instructions for manufacturing harmful devices.

2. Prohibited Activities

2.1 Network Abuse and Security Violations

  • Unauthorized Access: Attempting to access, probe, or connect to any computer, server, or network without authorization [citation:1][citation:2].
  • Denial of Service (DoS/DDoS): Engaging in or facilitating denial of service attacks, port scans, or other invasive procedures against any server, network, or user [citation:2][citation:9].

  • Vulnerability Testing: Performing security vulnerability scans, penetration tests, or similar assessments without explicit authorization from the system owner.

  • Cryptocurrency Mining: Running cryptocurrency miners, crypto-jacking scripts, or blockchain mining operations on our servers [citation:4][citation:9].

2.2 Email and Messaging Abuse

  • Spam/UCE: Sending unsolicited commercial email (spam), bulk email, or mass messaging without proper opt-in consent [citation:2][citation:4].
  • Email Harvesting: Collecting email addresses from websites or services without authorization for spamming purposes.
  • Mail Bombing: Sending large volumes of email to a single address or system to overwhelm it [citation:2][citation:9].
  • Phishing: Creating fake websites or sending deceptive emails designed to steal login credentials, financial information, or personal data [citation:3].
  • Open Relays/Proxies: Operating open mail relays, open proxies, or anonymous proxy servers [citation:2][citation:9].
  • CAN-SPAM Compliance: All commercial email must comply with applicable laws, including providing a valid opt-out mechanism and accurate sender information [citation:1].

2.3 Server Resource Abuse

  • Excessive Resource Usage: Using excessive server resources (CPU, memory, disk I/O) that negatively impacts other customers [citation:6].
  • Long-Running Processes: Running scripts or processes that consume 25% or more of system resources for extended periods (e.g., 60 seconds or longer) [citation:6].
  • Background Daemons: Running stand-alone, unattached server-side processes or daemons on shared hosting environments [citation:6].
  • Cron Job Abuse: Running cron scripts at intervals of less than 5 minutes or setting up excessive simultaneous cron jobs without approval [citation:6].
  • BitTorrent/P2P: Operating BitTorrent clients, peer-to-peer applications, or file-sharing services [citation:6].
  • Web Spiders/Bots: Running web spiders, indexers, crawlers, or scrapers that overload our systems [citation:6].

3. Domain Name Restrictions

When registering or using domain names through AviumsHost, you agree to comply with all applicable ICANN rules, registry policies, and laws [citation:1][citation:5]:

  • Accurate Information: Providing accurate and complete WHOIS information as required by ICANN and individual registries [citation:2].
  • No Domain Tasting: Engaging in domain tasting, domain kiting, or excessive domain testing practices is prohibited.
  • Cybersquatting: Registering domain names that infringe on trademarks, trade names, or intellectual property rights of others (bad faith registration) [citation:2].
  • Domain Phishing: Using domain names to impersonate legitimate businesses or organizations for fraudulent purposes.
  • Abusive Registrations: Registering domains primarily for the purpose of selling them at inflated prices to trademark holders (cybersquatting).

4. Security Obligations

  • Account Security: Maintaining strong passwords, enabling two-factor authentication where available, and keeping login credentials confidential [citation:1].
  • Software Updates: Keeping all installed software, scripts, applications, and content management systems up to date with security patches.

  • • Terminate your account and Services permanently

5.2 Repeat Offenders

Customers who repeatedly violate this AUP may have their accounts permanently terminated without refund. We reserve the right to consider the severity and frequency of violations when determining appropriate enforcement actions [citation:4].
