This Domain Name Registration Agreement ("Agreement") governs the registration and management of domain names purchased through AviumsHost. By registering a domain name through our services, you agree to be bound by the terms of this Agreement, along with our Terms of Service, Acceptable Use Policy, and any rules established by the relevant domain registry (such as ICANN) or specific top-level domain (TLD) operator.

1. Scope of Agreement

This Agreement applies to all domain name registrations, renewals, and transfers processed through AviumsHost. As a registrar partner, we facilitate your domain registration with the appropriate registry operator. Your domain name is subject to:

  • • The rules and policies of the relevant top-level domain (TLD) registry (e.g., .com, .org, .uk, .eu)
  • • ICANN (Internet Corporation for Assigned Names and Numbers) requirements where applicable
  • • This Agreement and all AviumsHost policies incorporated by reference

We may update this Agreement to comply with changes in registry requirements, ICANN policies, or applicable laws. Continued use of your domain after such changes constitutes acceptance of the updated terms.

2. Your Representations and Warranties

By registering a domain name through AviumsHost, you represent and warrant that:

  • • All information provided during registration is true, accurate, and complete
  • • You will maintain and update this information promptly if it changes
  • • To the best of your knowledge, the domain name registration does not infringe any third-party intellectual property rights
  • • You are not registering the domain name for any unlawful purpose
  • • You meet any eligibility requirements for the specific TLD (such as residency requirements for country-code TLDs like .uk or .eu)
  • • You have the authority to enter into this Agreement on behalf of any organisation you represent

3. Registration Process and Activation

When you purchase a domain name, you must complete the registration process by providing all required information within the specified timeframe. Domain registrations are not complete until:

  • • All required information has been submitted accurately
  • • Any necessary verification steps (such as email confirmation or identity verification) have been completed
  • • The registry has accepted and processed your registration

If you fail to complete the registration process within the required period, the domain name may be released and become available for others to register. In such cases, refunds are governed by our Refund Policy.

4. Fees, Payments, and Renewals

4.1 Registration Fees

You agree to pay all applicable fees for domain registrations, renewals, and transfers as displayed at the time of purchase. Fees vary by TLD and may include premium pricing for certain domain names designated by registries as having higher value.

4.2 Automatic Renewal

All domain registrations are set to automatically renew before their expiration date unless you disable auto-renewal in your account. We will attempt to charge the payment method on file for the renewal fee at then-current rates. It is your responsibility to ensure your payment information remains current and valid.

4.3 Expiration and Redemption

If a domain name is not renewed before its expiration date, it may enter a grace period during which it can still be renewed, potentially with additional fees. After the grace period expires, the domain may enter a redemption period where restoration is possible but incurs significant fees. Ultimately, if not restored, the domain will be released and become available for public registration. Redemption fees vary by TLD and are non-refundable.

4.4 No Refunds

Domain registration fees are generally non-refundable once a registration has been completed and accepted by the registry. This includes renewals and transfers.

5. WHOIS Information and Data Processing

ICANN and most TLD registries require that accurate contact information for domain registrants be made publicly available via the WHOIS directory. By registering a domain, you consent to:

  • • The collection, processing, and publication of your personal information as required by registry policies
  • • Your information being shared with the relevant registry and, where applicable, escrow providers
  • • Your information being accessible to third parties through WHOIS queries

Where privacy or proxy services are available for your TLD, you may choose to use them to mask your personal information from public WHOIS, subject to additional terms and fees.

You are responsible for ensuring your WHOIS information remains accurate. Failure to maintain accurate WHOIS information may result in suspension or cancellation of your domain registration.

6. Domain Transfers

Domain names may be transferred to or from AviumsHost in accordance with ICANN and registry transfer policies. Key conditions include:

  • • Domains generally cannot be transferred within 60 days of initial registration or a previous transfer (per ICANN rules)
  • • The domain must be unlocked, and you must provide a valid authorisation code (EPP code) where required
  • • Accurate WHOIS information must be on file, as transfer approval emails are sent to the registrant contact
  • • Some TLDs have specific transfer requirements or restrictions

Transfer fees are non-refundable once a transfer has been initiated and processed by the registry.

7. Dispute Resolution and Uniform Domain-Name Dispute-Resolution Policy (UDRP)

You agree to be bound by ICANN's Uniform Domain-Name Dispute-Resolution Policy (UDRP) and any other applicable dispute resolution policies for the relevant TLD. Under these policies:

  • • Third parties may challenge your domain registration on grounds of trademark infringement or abusive registration (cybersquatting)
  • • Disputes are typically resolved through arbitration by approved providers, not through the courts
  • • We may be required to suspend, lock, or transfer a domain name pursuant to a decision under the UDRP or a court order

You agree to indemnify and hold AviumsHost harmless against any claims, damages, or costs arising from a dispute over your domain name registration.

8. Suspension, Cancellation, and Transfer Restrictions

We reserve the right to suspend, cancel, or transfer your domain name registration under the following circumstances:

  • • To correct mistakes made by us or the registry in connection with the registration
  • • Upon receipt of a court order, arbitration award, or decision under the UDRP
  • • To comply with applicable laws, government requests, or ICANN mandates
  • • If we determine that your registration or use of the domain violates this Agreement or our Acceptable Use Policy
  • • For non-payment of fees
  • • If you provide false or inaccurate WHOIS information or fail to update it

No refund will be provided for domain names suspended or cancelled due to violation of this Agreement.

9. Specific TLD Provisions

Different TLDs have unique requirements. By registering in a particular TLD, you agree to comply with its specific registry policies:

9.1 .UK Domains

Registrations of .uk domains are subject to Nominet UK's terms and conditions. You must meet the eligibility criteria and agree to Nominet's dispute resolution service.

9.2 .EU Domains

.EU domains are restricted to individuals and organisations located within the European Union. You must meet the eligibility requirements and agree to EURid's terms and alternative dispute resolution rules.

9.3 .COM, .NET, .ORG, and Other Generic TLDs

These domains are governed by ICANN agreements and registry policies. Some may have specific requirements (e.g., .JOBS has employment-related restrictions). Premium domain names may have different renewal pricing.

9.4 .CN Domains

.CN registrations require real-name verification with submission of valid identification documents as required by Chinese authorities. Domains may not resolve until verification is complete.

It is your responsibility to review and understand the specific policies for your chosen TLD before registering.

10. Limitation of Liability

To the maximum extent permitted by law, AviumsHost and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your domain name registration, including but not limited to loss of the domain name, inability to use the domain, or interruption of service. Our total liability shall not exceed the amount you paid for the domain registration during the twelve months preceding the claim.

We are not responsible for:

  • • Actions or omissions of the registry operator
  • • Loss of your domain name due to expiration, if you failed to renew
  • • Decisions made under dispute resolution policies (UDRP, etc.)
  • • Technical failures beyond our reasonable control

11. Indemnification

You agree to indemnify, defend, and hold harmless AviumsHost, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • • Your domain name registration or use
  • • Any violation of this Agreement or applicable policies
  • • Any infringement of third-party intellectual property rights
  • • Any dispute with a third party regarding your domain name

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory dispute resolution policies (such as the UDRP) apply.
